To a question about terms of contract in share construction

Annotation

The article considers the individual terms of the contract of participation in share building: the term of the transfer by the developer of the object of shared construction party shared construction warranty period. These terms are essential conditions of the contract of participation in share construction of immovable property. The analysis of legal regulation of the period of transfer of the developer of the object of shared construction party shared construction and the warranty period with the use of judicial practice. In particular, the author suggests that the developer must deliver to the participant the shared construction of the object of shared construction not later than the deadline specified in the contract and not earlier than after receipt in the prescribed manner permissions on commissioning an apartment building or block section block of flats. Regarding the warranty period, the author concludes that, despite the fact that the condition of the contract of participation in share construction of warranty designed to act as significant, it is not. In the article it is proposed to amend the current legislation of the Russian Federation. Given that the warranty period is the period of realization of civil rights, not the date of performance of obligations, the law enough to fix the value of the warranty period is 5 years with a peremptory norm.
