Armed conflict in south-east of Ukraine and international criminal law

Annotation

Based on the study of legal essence of international and inner armed conflicts took place both in 20th and 21st centuries on territories of different states International legal analysis of crimes committed by soldiers and commanders during the counter-terrorist operation in the Donetsk and Lugansk regions of Ukraine is considered. Penal signs of war crimes committed during the armed conflict on the territory of Donetsk and Lugansk regions of Ukraine are defined, it is concluded that there is the possibility of the application of the Criminal Code of Russian Federation to Ukrainian citizens for crimes committed against Russian citizens, and also the opportunity of application of universal principle of action by Russian criminal law to subjects commuted crimes on territory of Ukraine against local population is considered. The criminal legal opinion about the impossibility of applying the circumstances precluding criminal responsibility in international criminal law for servicemen and commanders for crimes committed during the armed conflict is proved.
